1. About these terms
1.1These Publican Terms govern access to and use of BeersOn for Pubs and the related publican tools, pages, applications and services operated by Onfo Ltd, trading as Onfo Labs (“Onfo”, “BeersOn”, “we”, “us” or “our”).
1.2These terms form an agreement between Onfo and the business, organisation, sole trader or other operator responsible for the pub connected to the account (“Pub Business”, “you” or “your”).
1.3The individual using the account confirms that they are acting for business purposes and are authorised to enter into these terms on behalf of the Pub Business.
1.4These terms do not apply to ordinary customer use of BeersOn. Customer use is governed by the separate customer terms.
1.5Our Privacy Policy and Cookie Policy also apply to your use of BeersOn.
2. About BeersOn
2.1BeersOn is a digital discovery and pub-information platform that may allow pubs to:
- maintain public pub information;
- manage drinks and serving options;
- update opening and kitchen hours;
- add features, contact information and images;
- view and maintain their public BeersOn page; and
- use other tools that we make available from time to time.
2.2BeersOn is an information platform. Unless we expressly state otherwise for a particular feature, we do not:
- sell or supply alcohol;
- operate the pub;
- accept responsibility for the pub's licensing obligations;
- guarantee that any customer will visit or purchase from the pub;
- act as an agent for the Pub Business; or
- process bookings, ticket sales or customer payments.
2.3The Pub Business remains solely responsible for operating its premises and complying with all laws, licences, permissions and industry requirements that apply to it.
3. Eligibility and authority
3.1You may use BeersOn for Pubs only if:
- the Pub Business is lawfully operating or preparing to operate;
- you are at least 18 years old;
- you have authority to act for the Pub Business; and
- the information supplied to us is accurate and not misleading.
3.2We may ask for information or evidence confirming:
- your identity;
- your role or authority;
- the Pub Business's identity; or
- the relationship between the Pub Business and a pub.
3.3You must promptly tell us if your authority ends or changes.
3.4Access to a pub profile does not itself establish ownership, tenancy, management rights or any other legal interest in the pub.
4. Accounts and security
4.1Each account must be used only by the person to whom it was issued unless we expressly enable shared or staff access.
4.2You must:
- provide accurate account information;
- keep login details secure;
- use a strong password where password sign-in is available;
- prevent unauthorised access; and
- notify us promptly if you suspect misuse or compromise.
4.3You are responsible for activity carried out through your account unless it results directly from our failure to use reasonable security measures.
4.4You must not:
- share credentials with unauthorised people;
- impersonate another person or business;
- attempt to access another pub without authority;
- bypass security or access controls; or
- use automated methods to interfere with or extract data from the service without our permission.
4.5We may require you to reset credentials, verify your email or take other reasonable security steps.
5. Managing more than one pub
5.1We may link an account to more than one pub where the Pub Business has authority to manage each location.
5.2You must ensure that updates are made to the correct pub.
5.3You must not use multi-pub access to manage a pub for which your authority has ended.
5.4We may remove or amend a pub link where:
- ownership or operating responsibility changes;
- there is a dispute about authority;
- information is inconsistent or unreliable; or
- we reasonably believe access is unauthorised.
6. Accuracy of pub information
6.1You are responsible for the accuracy of information you submit or confirm, including:
- pub name and address;
- contact details;
- opening hours;
- kitchen or food-service hours;
- facilities, accessibility and features;
- drink availability and serving type;
- descriptions, menus, events and offers where available; and
- images and other content.
6.2You must update information promptly when it changes.
6.3You must not state that a drink, service, facility or event is available when you know or reasonably suspect that it is not.
6.4You must take reasonable care when confirming that a drinks list or pub profile is current.
6.5We may display when information was last changed or confirmed.
6.6We may correct formatting, spelling, categorisation, duplicate records or obvious factual inconsistencies without changing the substantive meaning of your information.
6.7We may request clarification or evidence where information appears inaccurate, misleading, duplicated or disputed.
7. Drinks and serving information
7.1You may use BeersOn to list drinks and serving options that the pub genuinely offers or expects imminently to offer.
7.2Each serving option may be treated separately, including Draught, Bottle and Can.
7.3You must update availability promptly and archive or hide offerings that are no longer relevant.
7.4Drink information may also include data supplied by producers, customers, catalogue sources or other third parties.
7.5We do not guarantee that third-party drink descriptions, images, ABV, style, allergen information or other details are complete or accurate.
7.6You should notify us of material catalogue errors and must not rely on BeersOn as a substitute for legally required product, allergen, licensing or customer-safety information.
7.7Customer sightings or logs do not necessarily represent information confirmed by the pub.
8. Your content
8.1“Your Content” means text, images, photographs, logos, descriptions, menus, event information, opening hours, drink information and other materials submitted or made available by you.
8.2You retain ownership of Your Content.
8.3You grant Onfo a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, resize, crop, format, adapt for technical presentation, display, distribute and otherwise use Your Content for:
- operating BeersOn;
- displaying and promoting the pub within BeersOn;
- creating previews, listings, search results and social or marketing materials relating to BeersOn and the pub;
- maintaining backups and security; and
- improving relevant BeersOn services.
8.4The licence continues while Your Content is used on BeersOn and for a reasonable period afterwards for backups, legal compliance and materials already published.
8.5You confirm that:
- you own Your Content or have permission to use and license it;
- Your Content does not infringe intellectual-property, privacy or other rights;
- people identifiable in images have been lawfully photographed and the image may be used as submitted;
- Your Content is accurate and not misleading; and
- Your Content complies with these terms and applicable law.
8.6You must not upload confidential information, customer personal data or private staff information unless the relevant BeersOn feature expressly requests it and you are legally permitted to provide it.
9. Prohibited content and conduct
9.1You must not use BeersOn to upload, publish or communicate content that:
- is unlawful, fraudulent or misleading;
- infringes another person's rights;
- is defamatory, threatening, abusive or discriminatory;
- contains malware or harmful code;
- promotes unlawful alcohol sales or irresponsible service;
- falsely claims awards, facilities, availability or affiliations;
- contains personal data that you are not entitled to disclose;
- impersonates another pub, producer or person; or
- is otherwise likely to harm users, the platform or third parties.
9.2You must not:
- disrupt or overload the service;
- reverse engineer the service except where the law expressly permits it;
- scrape, harvest or commercially reuse BeersOn data without written permission;
- circumvent rate limits or access controls;
- use the service to send spam; or
- use BeersOn in a way that damages the reputation of BeersOn or another business through dishonest conduct.
10. Moderation and corrections
10.1We may review, reject, hide, amend, suspend or remove content where we reasonably believe that it:
- breaches these terms;
- is unlawful or misleading;
- infringes rights;
- creates a safety or reputational risk;
- duplicates another record; or
- undermines the reliability of BeersOn.
10.2Where practical, we may contact you before taking action, but we are not required to do so where urgent action is reasonably necessary.
10.3We may preserve records where reasonably required for security, disputes, legal obligations or enforcement.
10.4If you believe content has been removed or changed incorrectly, contact us at hello@beerson.com.
11. Customer and third-party contributions
11.1BeersOn may display information contributed by customers, producers or other third parties.
11.2We do not endorse every contribution and cannot guarantee that all user-generated information is accurate.
11.3Publican access does not give you the right to alter or suppress legitimate customer history, favourites, reviews, sightings or other independent customer content, except where a feature expressly allows a response or correction.
11.4You may report content that you reasonably believe is unlawful, inaccurate or abusive.
11.5We may distinguish between information confirmed by a pub and information contributed by customers or other sources.
12. Intellectual property
12.1BeersOn, its software, design, databases, branding, logos and platform content are owned by or licensed to Onfo.
12.2Except for the limited rights needed to use the service, no intellectual-property rights in BeersOn are transferred to you.
12.3“BeersOn” and associated branding must not be copied, altered or used to imply endorsement without our written permission.
12.4You may use BeersOn-provided QR materials, badges or promotional assets only:
- for the linked pub;
- in accordance with any supplied brand guidelines; and
- while your publican access remains active.
13. Data protection and privacy
13.1Each party is responsible for complying with applicable data-protection law for personal data it independently controls.
13.2Onfo generally acts as controller for personal data used to:
- create and secure publican accounts;
- administer access;
- operate and improve BeersOn;
- prevent fraud and misuse;
- provide support; and
- meet legal obligations.
13.3The Pub Business remains responsible for personal data it chooses to include in content or otherwise provides for its own business purposes.
13.4You must not use BeersOn to upload customer or employee personal data unless:
- the relevant feature permits it;
- you have a lawful basis; and
- you have provided any required privacy information.
13.5Our handling of personal data is explained further in the Privacy Policy.
13.6If a future feature requires Onfo to process personal data solely on the Pub Business's documented instructions, the parties may need additional data-processing terms.
14. Service availability and changes
14.1We aim to provide a reliable service but do not guarantee that BeersOn will always be available, uninterrupted or error-free.
14.2We may:
- maintain, update or change the service;
- add, remove or alter features;
- impose reasonable technical or usage limits;
- suspend a feature for security or operational reasons; or
- discontinue all or part of the service.
14.3We will try to give reasonable notice of material changes where practical.
14.4You are responsible for maintaining your own copies of important business information. BeersOn is not a substitute for your operational records, licensing records, allergen records or point-of-sale systems.
15. Standard and paid services
15.1The standard BeersOn for Pubs service is currently provided without charge unless we tell you otherwise before you accept a paid service.
15.2We may introduce optional paid or Premium services in future.
15.3We will not charge you for a paid service unless:
- the price and billing terms are presented clearly; and
- the Pub Business expressly agrees to them.
15.4Additional terms may apply to paid services, promotions, trials or subscriptions.
15.5We may change the features included in the standard service, but we will not impose retrospective charges for past free use.
16. Third-party services
16.1BeersOn may link to or integrate with third-party services, including maps, authentication providers, websites, booking services or social platforms.
16.2Third-party services are governed by their own terms and privacy practices.
16.3We are not responsible for third-party services that we do not control.
16.4You are responsible for ensuring that external links you provide are accurate, safe and appropriate.
17. Suspension and termination
17.1You may stop using BeersOn for Pubs at any time and may ask us to remove or disable your publican access.
17.2We may suspend or terminate access where we reasonably believe that:
- these terms have been breached;
- access is unauthorised or disputed;
- information is materially inaccurate or misleading;
- there is fraud, misuse or a security risk;
- the Pub Business has ceased operating;
- continued access may cause legal or reputational harm; or
- suspension is reasonably necessary to protect users or the service.
17.3Where practical, we will explain the reason and give an opportunity to resolve the issue.
17.4We may act immediately where the issue is serious, urgent or legally required.
17.5Ending publican access does not necessarily remove:
- the underlying public pub record;
- customer-generated history;
- information from independent public sources; or
- records we must retain for legal, security or dispute purposes.
17.6Provisions intended to survive termination will continue, including those concerning content licences, intellectual property, liability, confidentiality, disputes and governing law.
18. Our responsibilities and disclaimers
18.1We will provide the service with reasonable care and skill.
18.2Subject to clause 19, BeersOn is otherwise provided on an “as available” basis.
18.3We do not guarantee:
- increased customers, revenue or visibility;
- uninterrupted availability;
- that all catalogue or customer information is accurate;
- that public information will appear instantly in every cache, search engine or third-party service; or
- that the service will meet every operational requirement of the Pub Business.
18.4Nothing in these terms limits rights or remedies that cannot lawfully be limited.
19. Liability
19.1Nothing in these terms excludes or limits liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation; or
- any other liability that cannot lawfully be excluded or limited.
19.2Subject to clause 19.1, Onfo will not be liable for:
- indirect or consequential loss;
- loss of profit, revenue, anticipated savings, goodwill or business opportunity;
- loss caused by inaccurate information supplied by you or a third party;
- loss caused by third-party services;
- loss resulting from unauthorised account use where you failed to keep credentials secure; or
- loss of data that you were responsible for keeping in your own operational records.
19.3Subject to clause 19.1, Onfo's total aggregate liability arising out of or in connection with these terms in any 12-month period will not exceed the greater of:
- £100; and
- the total fees paid by the Pub Business to Onfo for BeersOn services during the 12 months preceding the event giving rise to the claim.
19.4The limitations in this clause apply only to the extent permitted by law and taking account of all relevant circumstances.
20. Your responsibility for claims
20.1The Pub Business is responsible for losses, claims or reasonable costs suffered by Onfo as a direct result of:
- Your Content infringing a third party's rights;
- your lack of authority to manage a pub;
- unlawful or deliberately misleading information submitted by you; or
- your material breach of these terms.
20.2This clause does not make you responsible for losses caused by Onfo's own negligence, breach or unlawful conduct.
20.3We will take reasonable steps to mitigate any recoverable loss.
21. Changes to these terms
21.1We may update these terms to reflect:
- changes to BeersOn;
- legal or regulatory developments;
- security requirements; or
- changes to our business model.
21.2We will display the updated version and effective date.
21.3For material changes, we will give reasonable notice through the service, by email or by another appropriate method.
21.4Where required, we may ask you to accept updated terms before continuing to use publican tools.
21.5Continued use after the effective date of notified changes may constitute acceptance where legally permitted.
22. Notices and contact
22.1You can contact us at: hello@beerson.com.
22.2Legal notices to Onfo should also be sent to the registered office stated on the BeersOn Company page.
22.3We may contact you using the email address connected to your publican account or through notices within BeersOn.
22.4You must keep your account email current.
23. General
23.1These terms and any additional terms expressly agreed for a particular service form the entire agreement concerning BeersOn for Pubs.
23.2If any provision is unlawful or unenforceable, it will be treated as modified to the minimum extent necessary, and the remaining provisions will continue.
23.3A delay in enforcing a right does not waive that right.
23.4You may not transfer your rights or obligations under these terms without our written permission.
23.5We may transfer our rights and obligations as part of a reorganisation, sale, investment or transfer of the BeersOn business, provided this does not materially reduce your rights.
23.6Nothing in these terms creates a partnership, joint venture, employment or agency relationship.
23.7A person who is not a party to these terms has no right to enforce them under the Contracts (Rights of Third Parties) Act 1999.
24. Governing law and courts
24.1These terms are governed by the laws of England and Wales.
24.2The courts of England and Wales will have exclusive jurisdiction over disputes arising from or connected with these terms, except where applicable law requires otherwise.
